Terms of Service

1. The service

YukGo operates an online marketplace that matches shippers (cargo owners) with carriers (drivers, logistics companies) and provides related tools: listings, bidding, messaging, GPS tracking, escrow payment, ratings, insurance brokerage, analytics. YukGo is a technology information intermediary. It does not itself transport cargo, does not act as freight forwarder of record, and does not employ drivers; responsibility for physical performance of transport lies with the carrier.

2. Eligibility

• You must be at least 18 years old and have full legal capacity.
• Shippers and carriers must be duly registered businesses (individual entrepreneur or legal entity) or natural persons permitted by local law to trade cargo transport services.
• You must not be on any applicable sanctions list (OFAC, EU, UK, UN, or local equivalents).
• You must provide accurate and up-to-date KYC information and keep it current.

3. Accounts and credentials

You are responsible for all activity under your account. Keep your password confidential, use a strong password, and enable two-factor authentication where available. Notify us immediately at support@transport.oyam.asia of any suspected unauthorised access. We may suspend accounts pending investigation of suspicious activity.

4. Listings, bids and orders

1. Shipper posts a listing with accurate cargo details, origin/destination, weight/volume, timing and any hazardous-goods classifications.
2. Carrier submits a bid at a stated price. Unless rejected, the highest-ranking bid that meets acceptance criteria may automatically convert into an order.
3. An order is a binding contract of carriage directly between shipper and carrier. YukGo is not a party to that contract.
4. Changes to orders (re-routing, weight change, delay) must be agreed in the platform chat; material changes of price require consent of both parties.

5. Escrow and payments

• Unless the parties agree otherwise, shippers pre-fund the freight payment into a YukGo-managed escrow held with our payment partners.
• Funds are released to the carrier upon proof of delivery (electronic signature, photo, GPS arrival) and expiry of the dispute window.
• If a dispute is opened within the dispute window, funds remain frozen until resolved through our dispute process or by a competent court.
• YukGo may charge a success fee and/or membership subscription. Current fees are disclosed in the fee schedule inside the app. We may update fees on 30 days' notice.
• You are responsible for your own taxes (VAT, income, road tax, customs) arising from the transaction.

6. Prohibited conduct

You must not, and must not attempt to:

• Post false, misleading, duplicated or spam listings.
• Impersonate another person or business, or use borrowed KYC documents.
• Move transactions off-platform in order to avoid fees ("disintermediation").
• Transport goods that are illegal in any jurisdiction on the route, or undeclared hazardous / sanctioned goods.
• Harass, threaten, discriminate or send unsolicited commercial messages to other users.
• Reverse-engineer, scrape at scale, or probe the platform for vulnerabilities without written authorisation. Coordinated vulnerability disclosure: security@transport.oyam.asia.
• Use the platform to launder proceeds of crime or to evade international sanctions.

Violations may result in warning, suspension, permanent ban, forfeiture of escrow balances, and notification to competent authorities.

7. Ratings and reviews

Ratings must reflect your honest experience with the specific order. You may not pay for ratings, offer refunds in exchange for ratings, or review your own transactions. We may remove reviews that violate these rules.

8. Intellectual property

All software, designs, trademarks ("YukGo", "YukBazar", the flame-icon logo), documentation and databases are owned by YUKGO LLC or its licensors. You receive a personal, revocable, non-exclusive licence to use the service for its intended purpose. You retain ownership of your own content (listings, photos, ratings), but grant us a worldwide, royalty-free licence to host, display, translate (including machine translation), and derive anonymised aggregate statistics from it for the purpose of operating and marketing the service.

9. Warranty disclaimer

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted, error-free operation or that the service will meet your business goals.

10. Limitation of liability

• YukGo is not liable for cargo loss, damage, delay, theft or misdelivery — such liability, where it exists, belongs to the carrier under the applicable CMR, SMGS or domestic law.
• To the maximum extent permitted by law, our aggregate liability to you in any 12-month period is limited to the greater of (a) the platform service fees actually received from you in the preceding 12 months or (b) USD 500.
• We are not liable for indirect, consequential, punitive, or lost-profit damages, even if advised of their possibility.
• These limitations do not apply to liability that cannot be excluded by law (e.g. fraud, gross negligence, death or personal injury).

11. Insurance

YukGo may offer cargo insurance products brokered through licensed insurance partners. Cover, exclusions and claims procedures are defined in the relevant insurance policy. The insurance contract is between you and the insurer; YukGo acts only as an introducing broker and does not underwrite risk.

12. Suspension and termination

We may suspend or terminate your account: (a) if you materially breach these Terms; (b) if required by law, court order or regulatory body; (c) if your account is dormant for more than 24 months; (d) on 30 days' notice for convenience. You may delete your account at any time from settings, subject to the retention rules of the Privacy Policy and completion of outstanding orders. Clauses that by nature should survive termination (IP, liability, dispute resolution) will survive.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Uzbekistan, excluding its conflict-of-law rules. Disputes shall first be attempted to be resolved amicably. Failing that, disputes arising from or related to these Terms, the service or any order, where both parties are Uzbek entities, shall be submitted to the Economic Court of Tashkent city. For disputes involving a foreign party, the parties irrevocably submit to arbitration under the rules of the Tashkent International Arbitration Centre (TIAC), seat Tashkent, language English, by a sole arbitrator, unless otherwise agreed in writing.

Consumers resident in the Russian Federation, Kazakhstan or Kyrgyzstan may, as an alternative, choose to bring claims in the courts of their domicile to the extent mandatorily required by their local consumer-protection law.

14. Changes to these Terms

We may amend these Terms by posting an updated version here and notifying you in-app at least 30 days before the effective date (or immediately if the change is required by law or materially favours users). Continued use after the effective date constitutes acceptance. If you do not accept the changes, you must stop using the service.

YukGo — онлайн-маркетплейс, соединяющий грузовладельцев и перевозчиков. Платформа выступает информационным посредником и не осуществляет перевозку самостоятельно.

2. Требования к пользователям

• Возраст 18+ и полная дееспособность.
• Для ИП/юрлиц — действующая регистрация.
• Вы не находитесь в санкционных списках ООН/ЕС/США/Великобритании.
• Предоставляете достоверную KYC-информацию.

3. Аккаунты

Вы отвечаете за действия под своим аккаунтом. Используйте надёжный пароль и 2FA при наличии. О взломе сообщайте немедленно.

4. Объявления, ставки и заказы

Отправитель публикует объявление, перевозчик делает ставку, принятая ставка становится обязательным договором перевозки между отправителем и перевозчиком. YukGo не является стороной этого договора.

5. Эскроу и оплаты

Грузовладелец предварительно замораживает оплату на эскроу-счёте у наших платёжных партнёров; средства выплачиваются перевозчику после подтверждения доставки и завершения периода споров. При открытии спора средства замораживаются до разрешения.

6. Запрещённые действия

• Ложные/дублирующиеся/спам-объявления.
• Самозванство, использование чужих документов.
• Обход комиссий путём увода сделок вне платформы.
• Перевозка незаконных, необъявленных опасных или подсанкционных грузов.
• Домогательства, дискриминация, спам.
• Реверс-инжиниринг, массовый скрапинг, попытки взлома без письменного разрешения.
• Отмывание доходов, обход санкций.

7. Интеллектуальная собственность

Все права на ПО, дизайн и бренды YukGo принадлежат ООО YUKGO. Контент, загружаемый пользователями, остаётся их собственностью; вы предоставляете нам безвозмездную лицензию на размещение, отображение, машинный перевод и анонимизированную статистику.

8. Ограничение ответственности

YukGo не несёт ответственности за утрату, повреждение или задержку груза — такая ответственность несётся перевозчиком по применимому CMR, СМГС или национальному праву. Совокупная ответственность YukGo ограничена уплаченными нам за последние 12 месяцев сервисными сборами или 500 долл. США, в зависимости от того, что больше. Ограничения не применяются к случаям, которые по закону не могут быть ограничены (мошенничество, грубая неосторожность, вред жизни/здоровью).

9. Прекращение

Мы можем приостановить или прекратить аккаунт за существенное нарушение, по требованию закона, при бездействии > 24 месяцев или с уведомлением за 30 дней. Вы можете удалить аккаунт в настройках с учётом сроков хранения из Политики конфиденциальности.

10. Применимое право и разрешение споров

Право Республики Узбекистан. Споры между узбекскими сторонами — Экономический суд г. Ташкента. При участии иностранной стороны — арбитраж TIAC в Ташкенте, английский язык, единоличный арбитр.

11. Изменения

Уведомляем об изменениях не позднее чем за 30 дней через приложение.

YukGo — yuk egasi va tashuvchini bog'laydigan onlayn marketplace. Platforma faqat axborot vositachisi bo'lib, yuk tashishda bevosita qatnashmaydi.

2. Foydalanuvchilarga talablar

• 18 yoshdan katta.
• Tadbirkor/yuridik shaxslar — ro'yxatdan o'tgan bo'lishi shart.
• Sanksiyalar ro'yxatida bo'lmasligi kerak.
• Haqqoniy KYC ma'lumotlari.

3. Akkauntlar

Akkauntingiz ostidagi har qanday harakat uchun siz javobgarsiz. Kuchli parol va 2FA dan foydalaning.

4. E'lonlar, takliflar, buyurtmalar

Yuk egasining e'loni + tashuvchining taklifi qabul qilinishi natijasida yuk egasi va tashuvchi o'rtasida yuridik shartnoma tuziladi. YukGo bu shartnomaning tomoni emas.

5. Eskrou va to'lovlar

Yuk egasi to'lovni oldindan YukGo eskrouga kiritadi; yetkazib berish tasdiqlangandan so'ng va nizo muddati tugagach, mablag' tashuvchiga o'tkaziladi.

6. Taqiqlangan harakatlar

• Soxta/takroriy/spam e'lonlar.
• Boshqa shaxs sifatida ko'rsatish.
• To'lovlarni platformadan chetda amalga oshirish.
• Noqonuniy yoki sanksiyalangan yuklar.
• Skraping, tizimni buzish urinishlari.

7. Mas'uliyat chegarasi

Yuk yo'qolishi yoki shikastlanishi bo'yicha YukGo javob bermaydi — bu tashuvchining mas'uliyati. YukGoning yig'ma mas'uliyati sizdan so'nggi 12 oyda olingan xizmat haqlaridan yoki 500 USD dan oshmaydi.

8. Bekor qilish

Jiddiy buzilishda yoki 24 oy harakatsizlikda akkaunt to'xtatilishi mumkin. Sozlamalardan akkauntingizni o'chirishingiz mumkin.

9. Qo'llaniladigan huquq

O'zbekiston Respublikasi huquqi. O'zbek tomonlar o'rtasidagi nizolar — Toshkent sh. Iqtisodiy sudi. Xalqaro nizolar — TIAC (Toshkent) arbitrajida, ingliz tilida, bir hakamli.

1. 服务说明

YukGo 是一个在线货运撮合平台，为货主与承运人提供货源发布、运力匹配、站内沟通、GPS 追踪、运费托管（Escrow）、评价信用、保险经纪、数据分析等工具。YukGo 是技术信息中介，不亲自承运货物、不担任记录货代、不雇佣司机，货物实际运输责任由承运人承担。

2. 用户资格

• 年满 18 周岁并具有完全民事行为能力。
• 货主、承运人须为依法注册的个体工商户或法人（或当地法律允许从事货运的自然人）。
• 不得为联合国、欧盟、美国、英国或当地同等制裁名单上的主体。
• 须按要求提交真实、最新的 KYC 信息。

3. 账户与凭证

您应妥善保管密码，如有条件应启用二次验证。疑似被盗请立即邮件 support@transport.oyam.asia。我们可能基于可疑行为调查期间暂停账户。

4. 货源、报价与订单

1. 货主发布真实完整的货源（起止地、重量体积、时间、危险品等级）。
2. 承运人提交报价，符合接受条件的报价可自动转为订单。
3. 订单是货主与承运人之间直接成立的运输合同，YukGo 不是合同一方。
4. 订单变更需在平台内沟通，实质性价格变更须双方同意。

5. 托管与支付

• 除另有约定，货主须将运费预先充值至 YukGo 与支付合作伙伴共管的 Escrow 账户。
• 签收证明（电子签字、照片、GPS 到达）+ 争议期届满后，资金释放给承运人。
• 争议期内提出争议，款项保持冻结直至争议处理完毕或法院/仲裁裁决。
• 平台可能收取成功佣金或会员订阅费，具体以 App 内价目为准。费用调整提前 30 天通知。
• 用户自行负担交易产生的增值税、所得税、运输附加税、关税等。

6. 禁止行为

• 发布虚假、误导、重复、刷屏类信息。
• 冒用他人身份或借用他人 KYC 文件。
• 为规避平台费用而将交易转移至平台外。
• 承运任何路线任意辖区非法货物、未申报危险品或受制裁货物。
• 骚扰、威胁、歧视或向他人发送营销垃圾信息。
• 逆向工程、大规模抓取、未经授权的漏洞探测。漏洞请报告至 security@transport.oyam.asia。
• 洗钱或协助规避国际制裁。

7. 评价与信用

评价须真实反映您与具体订单的实际体验，不得买评、以退款换评、或评价自己的交易。违反规则的评价我们有权移除。

8. 知识产权

YukGo 的软件、设计、商标（"YukGo"、"YukBazar"、火焰图标）及数据库权利归 YUKGO LLC 或其授权方所有。您享有个人、可撤销、非独占的使用许可。您对自己上传的内容保留所有权，但授予我们免费、全球、可转授的许可，以承载、展示、机器翻译并据此产生匿名化汇总统计，用于运营与宣传服务。

9. 免责声明

服务按"现状""可用时"提供。在法律允许最大范围内，我们不做适销性、特定用途适用性、非侵权的默示担保。

10. 责任限制

• 货物灭失、损坏、延误、错交的赔偿责任由承运人依 CMR、SMGS 或当地法律承担，YukGo 不直接赔偿。
• 在法律允许最大范围内，我们在任何 12 个月内对您的总责任不超过 (a) 您过去 12 个月向我们实际支付的服务费总额或 (b) 500 美元，以较高者为准。
• 我们不对间接、偶然、惩罚性或利润损失担责。
• 上述限制不适用于欺诈、重大过失或人身伤害等法律不允许排除的责任。

11. 保险

YukGo 可通过持牌保险伙伴为您介绍货物保险产品。保险合同为您与保险公司之间订立，YukGo 仅以引介经纪人身份行为，不承担承保风险。

12. 暂停与终止

在以下情形我们可暂停或终止账户：(a) 您严重违反本协议；(b) 法律、法院或监管机关要求；(c) 账户休眠超过 24 个月；(d) 提前 30 天通知的便利性终止。您可随时在设置中申请注销。按性质应在终止后继续有效的条款（知识产权、责任限制、争议解决）继续有效。

13. 法律适用与争议解决

本协议适用乌兹别克斯坦共和国法律（冲突规则除外）。争议应先善意协商。协商不成且双方均为乌兹别克斯坦主体的，由塔什干市经济法院管辖；涉外争议不可撤销地提交塔什干国际仲裁中心（TIAC）仲裁，仲裁地塔什干，英文，独任仲裁员。

居住在俄罗斯、哈萨克斯坦、吉尔吉斯斯坦的消费者在其本国消费者保护强制性法律要求范围内，可选择在其住所地法院起诉。

14. 协议变更

本协议修订将提前至少 30 日在此处公布并通过 App 内通知告知（如法律要求或实质性有利于用户的修改可即时生效）。生效日后继续使用即视为接受。如您不同意，应停止使用服务。
